This privacy policy sets out our commitment to protecting the privacy of the users of ULTINEO (https://ultineo.com), the online shop builder that lets merchants create, dress and run their store, operated by EGOLEAP INTERNATIONAL LTD., registration number 2289501, registered office RM 05 2/F KINOX CENTER, 9 HUNG TO ROAD, KWUN TONG, KOWLOON, HONG KONG. It applies to visitors of ultineo.com and to merchants who use ULTINEO to run their shop.

This privacy policy and the terms of use form a single contractual whole. Terms in capitals not defined here have the meaning given in the terms of use.

We process personal data in accordance with data-protection law and the conditions below. A "personal data" item is any information relating to an identified or identifiable natural person. We collect only data that is adequate, relevant and limited to what is necessary for the purposes for which it is processed; we never ask for sensitive data (racial or ethnic origin, political, philosophical or religious opinions). By registering, you authorise us to process your personal data; if you refuse, please do not use the service.

1. What data we collect and when

We may collect and store your personal data when you:

  • browse the website;
  • create and use your merchant account;
  • pay for your plan online;
  • use the writing assistant;
  • contact our team.

We use your data to provide and secure the service, run your account and billing, answer your requests, improve the product and meet our legal obligations. We never sell it. If you opted in when creating your account, we may send you emails about our offering; you can unsubscribe at any time.

1.1 Browsing

Connection data: each time you connect we collect data such as your IP address, the date and time of connection, and information about the browser you use. Browsing data: how you reached the service, which pages you viewed and for how long, and the language and country you choose. We may use cookies for this — see the cookie policy.

1.2 Account creation

Some features require an account. As set out in the terms of use, you provide a number of personal data items on creation and while using your account: your name, email address and password, and the identity details of your shop that you choose to publish, such as the shop name, logo, contact details and social media links.

1.3 Payment

Paying for your ULTINEO plan relies on external service providers that may collect data to process card or alternative payments. To pay, you provide your billing and payment details; your card data is handled by the payment provider. Transaction details are kept in our systems and at the external payment provider for internal, accounting, compliance and legal purposes.

1.4 Contact

To follow up on requests to our customer service, we may use your name, email address and phone number, together with the content of your message.

1.5 Writing assistant

When you use the writing assistant, we process the product texts you submit so that it can draft descriptions, search texts and translations for your catalogue.

1.6 Your shoppers' data

When your shoppers buy from your store, their contact details, addresses, orders, payments and shipments are kept in your shop on your behalf. You, as the shop owner, decide what is collected and why; ULTINEO stores and protects this information for you, only to run your store, and never uses it for its own purposes or its own marketing. Each merchant publishes their own privacy notice for their shoppers on their store.

2. How we protect your data

Your data is hosted by OVH Groupe SAS, 2 rue Kellermann, 59100 Roubaix, France; the website and its data run in OVHcloud's London (United Kingdom) data center. Our operator is based in Hong Kong while the data is hosted in the United Kingdom; appropriate safeguards apply to this transfer.

We put in place technical and organizational security measures to guarantee the security, integrity and confidentiality of your personal data and prevent it from being distorted, damaged or accessed by unauthorised third parties, at a level appropriate to the state of the art and the risks. No security measure is infallible, so we cannot guarantee absolute security. It is also your responsibility to keep your account password confidential and to log out on a shared device.

3. When we share your data

3.1 With third-party companies

Your data may be transmitted to trusted external providers that act on our behalf to make the service work, notably hosting and card and alternative payments. Except where a third party asks you to accept its own policy, these companies undertake to process your data only to provide our service. We never sell your data, and we never share it with third parties for their own marketing without your prior consent.

3.2 With the authorities

We may disclose your data to administrative or judicial authorities where necessary to identify, stop or prosecute anyone who may harm our rights, another user or a third party, or where we are legally required to do so.

4. How long we keep your data

We keep your personal data for the duration of your registration, to identify you when you connect and to provide the service. If you close your account, your data is erased and kept only in archived form, for as long as the law requires, to establish a right or a contract. In any case we keep your data no longer than necessary for the purposes for which it is processed, in accordance with applicable law.

5. Your rights

Under Hong Kong's Personal Data (Privacy) Ordinance and, for visitors and shoppers in Europe, the UK and EU General Data Protection Regulation (GDPR), and after proving your identity, you have the right to request access to your personal data, its rectification or its erasure. You may also object to or restrict the processing, decide the fate of your data after death, withdraw your consent at any time, and exercise the right to data portability. To exercise your rights, contact us by email at help@ultineo.com, enclosing a copy of an identity document. You can also unsubscribe from our emails at any time via the link at the bottom of each email. If you are a shopper of a store built with ULTINEO, please contact that store first.

6. Changes to this policy

We may change this privacy policy at any time; please review it regularly. We will publish any change on this page with a new date. Your continued use of the service after a change means you accept it.
